I'm a little torn about Barker suing for the plane crash. If he knows for a fact (has concrete proof) the plane was defective, then yes, sue. If not, then don't stir up a ruckus just because.

Barker should sue because it's the threat of expensive lawsuits that motivates people to keep their planes in decent operating condition. He won't say the plane was defectively manufactured, but probably just in a defective condition because it was negligently maintained. (Like not having the tires serviced and tested).

If Barker can prove that the jet was negligently maintained, he'll win. If not, Barker won't get a dime. So, what's the harm? And I'm not sure, but I think people can only get emotional distress damages if they are attached to another tort claim for actual damage to body or property. Besides, if you saw one of your best friends burn to death in a plane crash, I think it would be pretty emotionally damaging. Why shouldn't he be compensated for that???

I'm surprised there are more than a few on here that don't have sympathy for the guy. I can't imagine what it must have been like to go through that.
